largement tabou. Lorsque des usages probl\u00e9matiques sont observ\u00e9s, nul ne sait ni comment r\u00e9agir, se positionner, ni comment les mettre en mots. Certains secteurs comme le BTP ou l\u2019agroalimentaire sont particuli\u00e8rement touch\u00e9s.<\/p><p>La loi fran\u00e7aise s\u2019est \u00e9galement durcie sur la question. L\u2019entreprise peut toutefois aller plus loin et\u00a0<strong>restreindre ou interdire totalement la consommation d\u2019alcool<\/strong>, notamment pour des raisons de s\u00e9curit\u00e9.<\/p><p class=\"my-2 [&amp;+p]:mt-4 [&amp;_strong:has(+br)]:inline-block [&amp;_strong:has(+br)]:pb-2\">L\u2019<span class=\"text-box-trim-both\">article R4228-21<\/span>\u00a0pr\u00e9cise quant \u00e0 lui qu\u2019il est interdit de laisser s\u00e9journer dans les locaux une personne en \u00e9tat d\u2019ivresse, sous peine d\u2019une amende pouvant atteindre 3 750 \u20ac par salari\u00e9 concern\u00e9.<\/p><p class=\"my-2 [&amp;+p]:mt-4 [&amp;_strong:has(+br)]:inline-block [&amp;_strong:has(+br)]:pb-2\">Enfin, concernant les \u201cpots d\u2019entreprise\u201d, aucune r\u00e8gle g\u00e9n\u00e9rale ne s\u2019applique : tout d\u00e9pend du lieu et du cadre de l\u2019\u00e9v\u00e9nement, comme le d\u00e9taille\u00a0<a href=\"https:\/\/www.addictaide.fr\/pro\/guide\/point-juridique-le-pot-en-milieu-professionnel\/\"><span class=\"text-box-trim-both\">Addict\u2019Aide<\/span><\/a>.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-88d4d00 elementor-widget elementor-widget-heading\" data-id=\"88d4d00\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"heading.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t<h2 class=\"elementor-heading-title elementor-size-default\">La responsabilit\u00e9 de l\u2019employeur : pr\u00e9venir, prot\u00e9ger, agir<\/h2>\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-d28b774 elementor-widget elementor-widget-text-editor\" data-id=\"d28b774\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p class=\"my-2 [&amp;+p]:mt-4 [&amp;_strong:has(+br)]:inline-block [&amp;_strong:has(+br)]:pb-2\">L\u2019article L. 4121-1 du Code du travail impose \u00e0 toute entreprise\u00a0<strong>de garantir la sant\u00e9 physique et mentale<\/strong>\u00a0de ses collaborateurs.<\/p><p class=\"my-2 [&amp;+p]:mt-4 [&amp;_strong:has(+br)]:inline-block [&amp;_strong:has(+br)]:pb-2\">D\u2019apr\u00e8s l\u2019OMS,\u00a0<em>15 \u00e0 25% des accidents du travail seraient li\u00e9s \u00e0 l\u2019alcool ou \u00e0 d\u2019autres substances psychoactives<\/em>. En cas d\u2019accident grave, notamment sur un poste \u00e0 risque, le manquement \u00e0 cette obligation peut constituer une\u00a0<strong>faute inexcusable<\/strong>\u00a0et exposer l\u2019employeur \u00e0 des sanctions p\u00e9nales.<\/p><p class=\"my-2 [&amp;+p]:mt-4 [&amp;_strong:has(+br)]:inline-block [&amp;_strong:has(+br)]:pb-2\">Face \u00e0 une situation d\u2019ivresse, un contr\u00f4le d\u2019alcool\u00e9mie est possible s\u2019il est pr\u00e9vu par le r\u00e8glement int\u00e9rieur. L\u2019entreprise peut ensuite d\u00e9cider d\u2019une sanction adapt\u00e9e, tout en privil\u00e9giant le\u00a0<strong>dialogue et l\u2019accompagnement<\/strong>\u00a0via les services de sant\u00e9 au travail.<\/p><p class=\"my-2 [&amp;+p]:mt-4 [&amp;_strong:has(+br)]:inline-block [&amp;_strong:has(+br)]:pb-2\">Mais l\u2019id\u00e9al reste d\u2019agir\u00a0<strong>en amont<\/strong>, avant offre une\u00a0<strong>opportunit\u00e9 unique<\/strong>\u00a0: aborder un sujet sensible sans \u00eatre moralisateur, \u00e0 travers une d\u00e9marche\u00a0<strong>positive, ludique et
